First, the accused must commit an act which is deemed by society to be criminal, or actus reus . Second, the accused must have the requisite malicious intent to do a criminal act, or mens rea . However, for so called “strict liability” crimes, an actus reus is enough. Criminal systems of the civil law tradition distinguish between intention in the broad sense , and negligence. Negligence does not carry criminal responsibility unless a particular crime provides for its punishment.

The discipline arose partly out of a critique of trade unions and U.S. antitrust law. Aviation law deals with all regulations and technical standards applicable to the safe operation of aircraft, and is an essential part both of pilots’ training and pilot’s operations. Non adherence to Air Law regulations and standards renders a flight operation illegal. It is framed by national civil aviation acts , themselves mostly aligned with the recommendations or mandatory standards of the International Civil Aviation Organisation or ICAO. They constantly evolve in order to adapt to new technologies or science . Environmental law is increasingly important, especially in light of the Kyoto Protocol and the potential danger of climate change.

Family law covers marriage and divorce proceedings, the rights of children and rights to property and money in the event of separation. Evidence law involves which materials are admissible in courts for a case to be built. Prominent examples of legislatures are the Houses of Parliament in London, the Congress in Washington, D.C., the Bundestag in Berlin, the Duma in Moscow, the Parlamento Italiano in Rome and the Assemblée nationale in Paris. By the principle of representative government people vote for politicians to carry out their wishes. Although countries like Israel, Greece, Sweden and China are unicameral, most countries are bicameral, meaning they have two separately appointed legislative houses.

United States Constitution

Historically, religious law has influenced secular matters and is, as of the 21st century, still in use in some religious communities. Sharia law based on Islamic principles is used as the primary legal system in several countries, including Iran and Saudi Arabia. National Journal of Law is a journal that publishes legal science articles, namely among others in the fields of civil law, criminal law, state administrative law, constitutional law, including all procedural law, as well as regarding cyber law, international law. Hegel believed that civil society and the state were polar opposites, within the scheme of his dialectic theory of history. The modern dipole state–civil society was reproduced in the theories of Alexis de Tocqueville and Karl Marx. In post-modern theory, civil society is necessarily a source of law, by being the basis from which people form opinions and lobby for what they believe law should be.

Ancient Egyptian law, dating as far back as 3000 BC, was based on the concept of Ma’at and characterised by tradition, rhetorical speech, social equality and impartiality. By the 22nd century BC, the ancient Sumerian ruler Ur-Nammu had formulated the first law code, which consisted of casuistic statements (“if … then …”). Around 1760 BC, King Hammurabi further developed Babylonian law, by codifying and inscribing it in stone.

The Eastern Catholic Churches, which developed different disciplines and practices, are governed by the Code of Canons of the Eastern Churches.
